Residents of AKME BALLET apartment protested against their Developers AKME Projects Ltd (an Anil Nanda Group) outside the AKME Project Office in Indra Nagar to voice their anger against the developer not delivering on its commitments to the residents. The residents resorted to Hunger protest and ?Gandhigiri Style? representation to fight against the atrocities of the Developer. There were more than 100 residents participating in this protest.
The AKME Ballet ? the ultra luxurious apartment project (located at Doddanakundi, Outer Ring Road) started sometime in 2005 with a promised date of delivery within two years is still not completed. AKME promised a lot of facilities like world class Club House with swimming pool, gymnasium, two elegant Club house and a range of outdoor and indoor games and Supermarket resembling all the amenities and features of a luxury resort. Unfortunately for the residents, most of the promised amenities are either not delivered or delivered in a pathetic state. The club house does not exist even today and a tennis court is an eye wash.
The main object of forming Apartment Owners Association is to perform the function of maintenance and work for welfare of owner?s of apartment. As per the Karnataka Apartment ownership Act, it is the duty of the Developer to transfer the Corpus fund collected to the Registered Apartment owners Association as soon as the Association is formed. AKME Projects Ltd, is refusing to transfer the Corpus Fund to the Registered Association even after the lapse of one year of the formation of our Association. The Developer is acting in total violation of the Apartment Law and the residents were dragged to enter in to another Maintenance Agreement. There are about 387 flats in AKME Ballet complex and the total deposit amounts to Rs 7.5 Crores which should be returned in full to the association by the developers.
The completion of the project has been delayed by more than two years, but the Developers have not bothered to complete the construction work yet and nor have they compensated the residents. At the time of entering the Construction Agreement the Developers have promised a compensation of Rs 2/ sqft in case of delayed delivery. Residents? complaints that even today the Apartment is not in a livable condition due to water logging, seepage and other basic problems.
Another important matter, as per the Notification dated 29th January 2009 issued by the Government any service tax collected from individual apartment owner?s right from the time of booking has to be entirely refunded to the apartment owners. The Developer has not taken any steps for the refund of service Taxes collected from the Apartment owners.
Residents allege that dozens of complaints and representations sent by them individually and through their Association to resolve these issues and to transfer the maintenance fund and proper maintenance of Apartment fell on deaf ears.
