Family members of a 23-year-old youth, who died in a road accident after being hit by a rashly driven car, have been awarded a compensation of nearly Rs 7 lakh by a Motor Accident Claims Tribunal (MACT).
MACT Presiding Officer Madhu Jain asked the owner of the offending car, to pay Rs 6,88,546 to the family of Madhya Pradesh resident Surender Kumar, who died in the accident in December 2007.
“Petitioners are able to prove that deceased Surender Kumar suffered fatal injuries due to rash and negligent driving of the respondent driver cum owner,” the Tribunal said.
According to the family’s petition, on December 23, 2007, Kumar along with other labourers was working at Sheikh Sarai, Ambedkar Marg, when the offending car, being driven in rash and negligent manner, hit him.
Due to the impact, he fell down on the road and received grievous injuries. He was admitted to AIIMS, where during the course of treatment he died.
His family members had claimed in the petition that Sharma was working in a private company and was earning Rs 12,000 per month.
During the proceedings, the insurance company claimed that the vehicle was not covered on the the date of accident.
Accordingly, the tribunal discharged United India Insurance Company in the case while the driver cum owner was proceeded.
