Articulating its view on the Ayodhya title suits verdict, the CPI(M) said it was based on faith and religion overlooking facts and evidence and that it therefore set a dangerous precedent. It also said the reasoning given in the judgement of the Allahabad High Court could be cited for justifying the demolition of the Babri Masjid.

After a two-day meeting of its Politburo, CPI(M) top boss Prakash Karat also criticised senior BJP leader LK Advani for his remarks that faith has been upheld by law. Karat saw no scope for reconciliation on the basis of the judgement. He expressed hope that the ?disturbing? aspect of the judgement giving primacy to ?religious beliefs and faith? over and above ?facts and evidence? would be addressed by the apex court.

? What is the out of court settlement? People are saying in good faith help us build the temple. They are not talking about the mosque. Is that the solution?? Karat said in a clear reference to the views expressed by RSS chief Mohan Bhagwat and top BJP leaders. The way to resolve the matter is through the judicial process and the decision of the Supreme Court would be final, he said.

Elaborating the party?s views on the judgement, Karat said the ?three-way division? of the land was based on ?faith and belief?. ?This aspect of the set of judgements is disturbing as it accords primacy to religious belief and faith over and above the facts and the record of evidence… Faith cannot be the basis of a judicial verdict on a title suit… It will set a dangerous precedent for the future,? he added.

Further, he said although the criminal case pertaining to demolition of the Babri Masjid was not a matter being considered by the Special Bench, ?there are apprehensions that the reasoning set out in the judgements may be taken as a post-facto justification for the demolition.? He wanted the cases related to the demolition be ?seriously pursued?.
