Congress leader Rahul Gandhi has landed himself in a lawsuit following his controversial remarks during the inauguration of the Congress Party’s new headquarters in Delhi. Gandhi stated on January 15, 2025, that “the BJP and RSS have captured every single institution, and we are now fighting the BJP, the RSS, and the Indian State itself.” His comments have lodged an FIR against him at the Pan Bazar Police Station in Guwahati.

The FIR, filed under Section 152 and 197(1)d of the Bharatiya Nyaya Sanhita (BNS), accuses Gandhi of “acts endangering sovereignty, unity, and integrity of India,” a cognizable and non-bailable offense.

The complaint, filed by Monjit Chetia, claims that Gandhi’s statement crossed the boundaries of permissible free speech and posed a serious threat to national security and public order. Chetia accused the Congress leader of attempting to delegitimize the authority of the Indian State, warning that such remarks could incite unrest and separatist sentiments.

“By declaring that his fight is against the ‘Indian State itself,’ the accused has consciously incited subversive activities and rebellion among the populace. This attempt to portray the Indian State as a hostile force creates a dangerous narrative,” Chetia stated in his complaint.

Chetia also suggested that Gandhi’s remarks stemmed from frustration over his repeated electoral setbacks. He argued that, as the Leader of the Opposition, Gandhi had a responsibility to uphold public trust in democratic institutions. However, instead of maintaining this trust, Gandhi was accused of exploiting his platform to spread falsehoods and provoke rebellion.

“Unable to gain public trust through democratic means, the accused seeks to incite disaffection against the government and the Indian State. His actions undermine the stability and unity of India,” Chetia said.

The legal action comes at a time when the political climate in India is already charged with tension. Gandhi’s comments have ignited widespread debate, with some condemning his remarks as reckless, while others argue that they reflect the ongoing political struggle between the ruling BJP and the Opposition.
