Tata Motors on Monday moved an appeal to a division bench of the Calcutta High Court challenging the verdict of the single bench in Singur case.

The move came barely a month after the HC ruled that the law enacted by the West Bengal government to return the Singur land to the farmers is constitutional and valid.

Advocate Samaraditya Pal, counsel for Tata Motors, on Monday mentioned before the division bench of Justice Kalyanjyoti Sengupta and Justice Jaymalya Bagchi for hearing the appeal of Tata Motors. The division bench asked Pal to file an appeal before it.

Justice IP Mukherjee had observed on September 28 that the Singur Land Rehabilitation and Development Act, 2011, and the Singur Land Rehabilitation and Development Rules, 2011, were valid and constitutional. The West Bengal government had vested the land leased to the company at Singur under the Singur Land Rehabilitation and Development Act, 2011.

Meanwhile, vendors of the shelved Tata small car project at Singur have also challenged the validity of the Singur Act. A counsel for the several vendors on Monday urged Justice Mukherjee to extend the stay order which is scheduled to expire on November 2. Mukherjee declined the plea.

The court had earlier ordered an unconditional stay of the judgement till November 2 to allow any aggrieved party to file an appeal, if it so desired.
