The European Commission has initiated two specification proceedings aimed at assisting Apple in meeting its interoperability obligations under the Digital Markets Act (DMA). This move highlights the EU’s commitment to ensuring fair competition in the digital marketplace.
Under the DMA, Apple is required to provide free and effective interoperability for third-party developers and businesses using its iOS and iPadOS operating systems. The first proceeding will examine various connectivity features and functionalities within iOS that are critical for connected devices such as smartwatches, headphones, and virtual reality headsets. The Commission aims to assist Apple on it can ensure effective interoperability, particularly regarding functionalities like notifications, device pairing, and overall connectivity. This is essential for manufacturers relying on seamless integration with Apple’s ecosystem.
The second proceeding will scrutinise the processes Apple has established to handle interoperability requests from developers and third parties. The Commission emphasises the need for a transparent, timely, and fair request process, allowing developers to innovate and gain predictable access to interoperability with Apple’s platforms.
The Commission aims to conclude these proceedings within six months. Throughout this period, preliminary findings will be communicated to Apple, outlining the measures necessary for compliance with the DMA’s interoperability obligations. This initiative is part of the EU’s broader efforts to regulate large digital platforms that play a crucial role in connecting businesses and consumers.
On September 6, 2023, the Commission designated Apple’s App Store, iOS, and Safari as core platform services under the DMA. Apple is required to fully comply with DMA obligations for iOS by March 7, 2024, and for iPadOS by October 30, 2024.
Margrethe Vestager, Executive Vice-President in charge of competition policy, stated, “Today is the first time we use specification proceedings under the DMA to guide Apple towards effective compliance. We are focused on ensuring fair and open digital markets. This process will provide clarity for developers, third parties, and Apple.”
