An FIR has been registered against Krafton India, the developer of the popular online game Battlegrounds Mobile India (BGMI), for allegedly selling user data on Telegram, according to a report by TalkEsport.com.
The complaint, filed by Santosh Torane from Maharashtra, accuses the company of breaching contract terms, leaking confidential data, and unlawfully sharing user information. TalkEsport has also published a copy of the original FIR in its report.
Allegations against Krafton
Filed by the Akluj Police in Maharashtra’s Solapur district in September 2023, the FIR states that Torane had entered into an online service agreement with Krafton in August 2021. He claims the company, along with four of its executives, violated the confidentiality clauses of that agreement.
The FIR further alleges that Krafton has been illegally monetising user data, selling it via unauthorised channels for Rs 2,000 per subscriber. The charges include criminal conspiracy (IPC Section 120-B), cheating (IPC Section 420), and violations of the IT Act under Sections 72, 72A, and 85.
Legal proceedings and upcoming hearing
After receiving no response to complaints filed in November 2023, Torane approached the Judicial Magistrate First Class at Malshiras. In August 2024, the court directed the Akluj Police to investigate the matter under Section 156(3) of the Criminal Procedure Code.
Krafton, in turn, moved the Bombay High Court seeking relief. A bench comprising Justices Sarang V Kotwal and Dr. Neela Gokhale has clubbed the related petitions and scheduled a hearing for April 15, 2025. All interim orders will remain in effect until then.
Krafton’s response
Krafton issued an official statement to TalkEsport, saying:
“At KRAFTON, the protection of personal data is of utmost importance to us, and we are committed to upholding the highest standards of data security. As the matter is currently sub judice, we believe it is best to wait for the legal process to conclude, after which we will provide any necessary clarifications.”
