The US Embassy in India has warned foreign nationals visiting the United States not to overstay their visit. In a post on X, the US Embassy in India writes – Your authorized period of stay is the “Admit Until Date” on your I-94, not your U.S. visa expiration date. Staying in the United States beyond your authorized date is called an “overstay” and could result in a visa revocation, possible deportation, and ineligibility for future visas.

Form I-94 for Travellers

Form I-94 is an arrival/departure record issued by U.S. Customs and Border Protection (CBP) to foreign visitors to the United States.

A Form I-94 is needed by all visitors except U.S. Citizens, returning resident foreigners like Green Card holders, and foreigners with immigrant visas such as H-1B workers.

Travelers will be issued an I-94 during the admission process at the port of entry. If you are traveling via a land border or by ferry from selected ports, you may apply for a provisional I-94 in advance, saving time while at the port of entry later.

Admit Until Date

The ‘Admit Until Date’ is the date that the traveler’s immigration status expires in the U.S. The ‘Admit Until Date’ should be used for U.S. Citizenship and Immigration Services (USCIS) or public benefits from other government agencies.

The Admit Until Date is the date that the traveler’s immigrant status expires. For students and other exchange visitors, this date is “D/S” or Duration of Status. For other visa classifications, this will be a hard end date.

Your permissible stay period is determined by the “Admit Until Date” on your I-94, not the expiration date of your US visa. Staying in the United States after your allotted date is known as an “overstay” and can result in visa revocation, deportation, and ineligibility for future visas.

To comply with your admission terms, you must either leave by 11:59 p.m. Eastern Time (ET) on the last day of your admission, the admit until date on your I-94, or have filed an application with United States Citizenship and Immigration Services (USCIS) to extend, change, or adjust your status as listed on Form I-94.
