While the Industrial Relations Code, 2020 and the Occupational Safety, Health and Working Conditions Code, 2020 have been implemented in full, few clauses of the Code on Social Security, 2020 and the Code on Wages, 2019 have been excluded.

Full Implementation of IR and OSH Codes

In the Social Security Code, the government has kept in abeyance parts of sections 15(3), 16, entire section 142, certain transitional provisions in section 143, and select clauses of section 164. 

These relate to retrospective application of EPF schemes, repeal of the 1952 EPF Act, coverage thresholds and unorganised-sector social security frameworks.

Abeyance of Central Advisory Board

Under the Wages Code, the Centre has deferred sub-sections (1) to (3) of section 42 — which provide for the constitution, composition and functions of the Central Advisory Board — and the corresponding rule-making powers under section 67(2)(s). Certain legacy provisions under section 69 have also been excluded.

With most substantive provisions now operational, industry expects quicker roll-out of unified rules, though the 
pending advisory and transitional clauses may still cause some short-term uncertainties.
