Almost 9 months since the case, the United States Securities and Exchange Commission (SEC) has yet not served summons on Gautam Adani and his nephew Sagar Adani in India. In a status report filed on August 11, 2025, US SEC has informed the New York City court that it is still awaiting delivery of summons to industrialist Gautam Adani and Sagar Adani.
The US regulator had filed a civil and criminal complaint against the billionaires and the Adani entity nine months ago.
The US SEC said that since the defendants are located in India, the regulator is in touch with India’s law ministry to serve the Adanis with legal documents related to a civil suit alleging violations of American securities laws.
“As described in the SEC’s prior status updates, the SEC has requested assistance from India’s Ministry of Law & Justice (India MoLJ) under Article 5(a) of the Hague Service Convention in serving the Summons and Complaint on Defendants in India. The SEC has also sent Notices of Lawsuit and Requests for Waiver of Service of Summons, including copies of the Complaint, directly to the Defendants and to counsel, but has not received responses from the India MoLJ,” the latter stated.
It further maintained that the SEC will continue to communicate with the India MoLJ on the matter.
Before this, the SEC had filed status updates concerning its ongoing service efforts on April 23, 2025, and June 27, 2025.
The $265 million bribery case
The case involves accusations by US prosecutors against Gautam Adani, Sagar Adani, and six others, alleging they paid bribes worth Rs 2,029 crore ($265 million) to Indian government officials to obtain lucrative solar energy supply contracts from state electricity distribution companies.
In November 2024, the SEC had accused the two businessmen of being involved in the case and violating US securities laws by issuing false and misleading statements concerning a bond offering by Adani Green Energy Ltd in September 2021.
Gautam Adani denies allegations
Earlier in April, Adani Green had confirmed that an independent review of the US indictment against Gautam Adani and top executives did not find any irregularities or non-compliance. The company had added that it does not anticipate any material consequences from the US proceedings.
In June, while addressing shareholders at Adani Group’s annual general meeting (AGM), Gautam Adani had stated that no one from the Group has been charged with violating the US Foreign Corrupt Practices Act (FCPA) or conspiring to obstruct justice.
