Court order and details of divorce
“In light of the aforementioned details in the present case, it is evident that the respondent (wife) has displayed behavior towards the appellant (husband) that lacks dignity and empathy. When one spouse treats the other in such a manner, it tarnishes the fundamental principles of marriage, and there is no justification for subjecting the appellant to the anguish of continuing such a relationship,” stated a bench comprising Justices Suresh Kumar Kait and Neena Bansal Krishna.
The couple, who married in April 2008 and had a son in 2012, is now estranged. In his petition, Kunal Kapur accused his wife of disrespecting his parents and humiliating him repeatedly.
On the other hand, the woman countered, alleging that he fabricated stories to mislead the court and sought a divorce. She claimed to have always endeavored to communicate with her husband affectionately and remained loyal to him. However, she alleged that he deceived her and concocted falsehoods to justify seeking a divorce.
The court noted that while conflicts are inevitable in marriages when they manifest as disrespect and disregard for one’s spouse, the sanctity of the marriage is compromised.
“It’s pertinent to note that within two years of marriage, the appellant has risen to prominence as a celebrity chef, which reflects his dedication and hard work…”
“Considering the aforementioned details, it is prudent to regard the respondent’s accusations as attempts to tarnish the appellant’s reputation before the court. Such baseless claims constitute cruelty as they adversely affect one’s reputation,” the bench concluded.
