Priya Kapur, the third wife of late industrialist Sunjay Kapur, has approached the Delhi High Court seeking a confidentiality agreement before revealing details of her late husband’s assets. In her plea, Priya has requested that the non-disclosure agreement (NDA) be signed by Sunjay’s mother, Rani Kapur, and the children of his second wife, Bollywood actress Karisma Kapoor, before she discloses the information.
Priya’s decision comes after the last hearing, when the High Court had ordered her to disclose the personal assets of Sunjay Kapur. Replying to the court, she said she is willing to provide the asset details in a sealed cover, provided that Rani Kapur and Karisma’s children Samaira and Kiaan sign the NDA.
Karisma Kapoor had married Sunjay Kapur in 2003, and the couple divorced in 2014. The next hearing in the matter is scheduled for tomorrow at 10 am.
Court hearing update
On Thursday, September 25, the Delhi High Court heard an application from Priya Kapur seeking permission to file the list of personal assets and liabilities of her late husband, Sunjay Kapur, in a sealed cover. The matter was listed before the Bench of Hon’ble Ms. Justice Jyoti Singh.
The court, on Thursday, stressed the importance of transparency in inheritance disputes, especially when other heirs have a legitimate claim. Justice Jyoti Singh heard the matter on Thursday but expressed apprehensions about whether such an order can be passed as it may ‘create some problems’.
“It may be problematic for the simple reason that as the alleged beneficiary of the estate, they [Karisma Kapur’s children] have a right to question the assets disclosed…So, tomorrow, if they have to verify and go about asking what has happened, if they are bound with this confidentiality club, how will they ever defend their case?” the Court asked.
She challenged this request, asking how much information could realistically be kept under wraps and how the court could enforce such an order. She also asked Priya Sachdev’s team to point out any legal provision that allows asset disclosures to remain confidential.
Priya Kapur seeks sealed submission
Priya Kapur’s legal team argued that the details of Sunjay Kapur’s assets include sensitive financial information, and public disclosure could cause irreparable harm. They requested the court to allow the documents to be submitted under a sealed cover with strict confidentiality, or alternatively, to create a “Confidentiality Club” to protect the information.
Rani Kapur’s application
In the same hearing, Rani Kapur filed a separate application seeking access to the Will dated March 21, 2025. After hearing arguments from both sides, the court decided to take up both applications tomorrow (September 26). This will allow the lawyers to propose a method to maintain document confidentiality while protecting the rights of all parties involved.
Legal representation
Priya Kapur was represented by Senior Advocate Shyel Trehan, while Master Azarius S. Kapur’s team included Senior Advocate Akhil Sibal, briefed by Bahuguna Law Associates, with Ms. Meghna Mishra (Senior Partner), Mr. Ankit Rajgarhia (Partner Designate), Mr. Tarun Sharma (Principal Associate), and Mr. Rohit Kumar (Associate).
Sunjay Kapur’s sudden death
Sunjay Kapur, the chairman of Sona Comstar, passed away in June from a reported bee sting while playing polo in the UK. His sudden demise left everyone in shock including the business community and family. Priya Kapur was recently seen in public attending an event of the Automotive Component Manufacturers Association of India (ACMA), where she was inducted into the executive committee. Sunjay had previously served as ACMA president, and Priya’s induction is being seen as a strategic move to strengthen her position in the industry.
Rani Kapur raises foul play concerns
Since Sunjay’s sudden death, Rani Kapur has expressed suspicions of foul play. She also wrote to UK authorities, asking for an investigation into his death and requesting that natural causes be ruled out. Rani suggested that murder, conspiracy, or financial fraud could be possible reasons for her son’s sudden passing.
Sunjay’s sister, Mandhira Kapur Smith, also voiced concerns, telling ANI, “There was a simple request from my mother. We have gone through the loss of a family member. For us, it was my mum’s son; for me, it was a brother. When was his last medical test done? Did he check his heart? My mum asks me every day, how did this happen? He was fit. Who is giving her answers?”
Priya’s position in the industry
Apart from the inheritance battle, Priya’s recent induction into ACMA’s executive committee shows that she will continue Sunjay Kapur’s legacy in the business world. Industry insiders note that her position strengthens her influence in the automotive component sector and consolidates her role in the association previously headed by Sunjay.
