US Citizenship and Immigration Services (USCIS) has announced a final rule that will increase the filing fee for Form I-907, Request for Premium Processing, to adjust for inflation. After maintaining the fees unchanged for three years, the premium processing fees charged by USCIS for all eligible forms and categories are now being increased.

Form I-907 is the form to be used to request for processing of eligible forms in an expedited manner called Premium processing or faster processing. The eligible forms and categories allowed under Form I-907 – Request for Premium Processing form include Form I-129, Form I-140, Form I-765 and Form I-539.

The adjustment increases certain premium processing fees from USD 1500 to USD 1685, USD 1750 to USD 1965, and USD 2500 to USD 2805. You must pay the Form I-907 fee separately from other filing fees. If you submit a single, combined fee payment for multiple forms, USCIS will reject the forms for improper payment.

The fee change will go into effect on 26 February 2024. If USCIS receives a Form I-907 postmarked on or after 26 February 2024 with the incorrect filing fee, it will reject the Form I-907 and return the filing fee.

There is a fee to request this service. If you request premium processing, USCIS guarantees that they will take adjudicative action on the case, within the periods described below, or they will refund the premium processing fee:

  • 15 calendar days for most classifications;
  • 30 calendar days for Form I-765 for F-1 students seeking OPT or STEM OPT extensions;
  • 30 calendar days for Form I-539 applicants requesting a change of status to F-1, F-2, M-1, M-2, J-1, or J-2 nonimmigrant status
  • 45 calendar days for Form I-140 E13 multinational executive and manager and Form I-140 E21 national interest waiver classifications

H-1B, H-2B, and certain H-3 classifications may have annual numerical cap restrictions. It is better to verify whether a cap applies to your filing and whether that cap has been met. Filing Form I-907 does not give special cap benefits to you.

The H-1B visa is a nonimmigrant work visa that allows American firms to hire foreign workers with particular talents to work in the United States for a defined length of time.

New Fee Structure

  • Form I-129, Petition for a Nonimmigrant Worker – $2,805 (All other available Form I-129 classifications (E-1, E-2, E-3, H-1B, H-3, L-1A, L-1B, LZ, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1, TN-1, and TN-2))
  • Form I-539, Application to Extend/Change Nonimmigrant Status – $1,965 (Form I-539 classifications F-1, F-2, M-1, M-2, J-1, J-2, E-1, E-2, E-3, L-2, H-4, O-3, P-4, and R-2)
  • USCIS accepts Form I-907 requests, filed either via paper form or online, for applicants seeking a change of status to F-1, F-2, M-1, M-2, J-1, or J-2 status, when filed together with Form I-539. The nonimmigrant academic student (F-1) classification allows a noncitizen to enter the United States as a full-time student at a college or university.

  • F-1 Academic Student and F-2 Dependent of F-1;
  • M-1 Vocational Student and M-2 Dependent of M-1; or
  • J-1 Exchange Visitor and J-2 Dependent of J-1.
