Tata Motors is likely to move the Supreme Court on Tuesday seeking to restrain the West Bengal government from distributing to farmers in Singur the land acquired earlier to set up its car manufacturing unit.

However, the state government filed a caveat in the apex court on Monday so as to ensure that the no order is passed without hearing it.

During the earlier part of the day, the Calcutta High Court had refused to pass an interim order to restrain the Mamta Banerjee government from distributing the land to farmers.

While Tata Motors? had sought to restrain distribution of the land from Tuesday, justice Saumitra Pal of the high court had refused relief on the ground that the company?s original plea challenging the Singur Land Rehablitation and Development Act, 2011 would become infructuous.

Justice Pal observed that since the court found from the petition that no specific statement had been made that land distribution would start on Tuesday, no interim order was being passed.

Tata Motor had expressed apprehension that land would be distributed within a day or two. However, the West Bengal Industrial Development Corporation had opposed the prayer.
