The US visa bulletin for October has been released by the Department of State. The October visa bulletin shows that the Final Action Date for EB-5 India applicants will move forward by almost 15 months. The Final Action cutoff dates will be crucial for the issuance of an immigrant visa or the approval of an adjustment of status application.
The EB-5 Visa is considered the fastest method for foreigners to settle in the US, with a lawful permanent residency through a green card, and offering a route to American citizenship.
This is the first visa bulletin for the fiscal year 2026 that begins on October 1 and ends on September 30, 2026.
The fiscal year 2026 limit for family-sponsored preference immigrants determined in accordance with Section 201 of the Immigration and Nationality Act (INA) is 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.

The US visa bulletin shows the deadlines for Final Action Dates and Dates for Filing Applications by immigrant visa applicants for submitting necessary paperwork to the National Visa Center, for demands received by September 3rd.
EB-1: China will advance by five weeks from 15 November to December 22, 2022, and India will remain at February 15, 2022. All other countries will continue to be current.
EB-2: China will advance by three and a half months from 15 December to April 1, 2021, and India will advance by three months from 01 JAN 13 to April 1, 2013. All other countries will advance by three months to December 1, 2023.
EB-3 Professionals and Skilled Workers: China will advance by three months from 01DEC20 to March 1, 2021, India will advance by three months from 22MAY13 to August 22, 2013, and the Philippines will advance by seven weeks from 08FEB23 to April 1, 2023. All other countries will remain on April 1, 2023.
EB-5: For the EB-5 Unreserved categories, China will remain at December 8, 2015, and India will advance by almost 15 months from 15 November 2019 to February 1, 2021. All other countries will remain current. The EB-5 set-aside categories (Rural, High Unemployment, and Infrastructure) will also remain current.
For EB-5 India, there is no change in dates for filing of employment-based visa applications, as it stays at 01 April 2022.
