The Delhi High Court has ruled invalid disqualification of Italian vendor Ansaldo from NTPC?s R9,000-crore tender for the bulk supply of supercritical boilers.

In a verdict delivered on Tuesday, the court upheld Ansaldo?s complaint that its bid was wrongly rejected by NTPC. However, it did not find any malafide intention behind rejection of the complainant?s bid.

The court has directed NTPC to hold technical discussions with Ansaldo and allow it to submit price bid for the project. An official in NTPC said that the company will take a decision in this matter after reading the judgment.

L&T Power, Bhel, BGR Energy as well as Ansldo had submitted bids for the project. However, Ansaldo?s bid was rejected in January. Subsequently, it challenged NTPC?s decision in the Delhi high court.

?W are thankful to the honourable court. It has upheld our complainant. We will submit our most competitive bid,? a senior official in Ansaldo said.

NTPC?s bidding for the project is running behind schedule as the central utility had to re-tender earlier when L&T Power?s bid was disqualified earlier. NTPC has completed evaluation of price bids for the bulk supply of 660 mw turbine-generator. However, the award of contract is held up due to delay in finalisation of boiler supply contract.
