The Ministry of Information and Broadcasting (MIB), recently, notified all advertisers that providing a self-certification for advertisements is now mandatory. As per the notification, all advertisers/advertising agencies are mandated to submit self-certification for their advertisements before releasing them for public viewing. The notification has mentioned two portals for all advertisers/advertising agencies to generate their self-certificate, namely broadcastseva.gov.in for TV/Radio advertisements and presscouncil.nic.in for Print or Internet advertisements. Moreover, the mandate requires advertisement publishers/broadcasters/Internet platforms to secure the self-certificate from advertisers/advertising agencies, prior to release of new advertisements from June 18, 2024. 

The recent step led to quite a stir in the industry and has sowed seeds of doubts on its implications, especially in the case of the digital advertising ecosystem. Industry body, Advertising Standards Council of India (ASCI), today issued a clarification on the same.” This has reference to a certain news item which appeared in media today stating that ASCI has asked its members and other advertisers not to release advertisements post-June 18 till July 9th and await the Supreme Court’s clarification on the self-declaration certificate. ASCI would like to clarify that it has asked its members or others not to issue any new advertisement WITHOUT a self-declaration certificate (SDC). Any new ad post-June 18th can be released with the SDC as mandated by the Supreme Court and as notified by MIB,” Manisha Kapoor, CEO and secretary General, ASCI, said.
