The Tesla US vs Tesla Gurugram case has seen developments, and as per the latest reports, mediation talks between the two companies have failed, and the Delhi High Court will hear the dispute on April 15. Tesla Inc, the US EV maker and Tesla Power, the Indian battery maker, have had a clash over trademark infringement.
Tesla vs Tesla — What actually happened?
Tesla US sued Tesla Power in May last year over trademark infringement issues. The US carmaker sued the Indian company alleging that it is misleading customers and is also causing confusion and possibly even damage to its reputation. Tesla Power was also accused of selling e-scooters under the Tesla name.
Tesla Power said that 699 e-scooters were sold under the Tesla name, but its primary business is lead-acid batteries for automobiles and inverters, while it does not manufacture electric vehicles. The e-scooter sales was an alliance with another EV maker named E-Ashwa and Tesla Power said that it does not intend to make electric vehicles at all.
Tesla vs Tesla — What now?
The Delhi court will now proceed with the hearing in April and the decision was made after noting that mediation efforts by the two companies have yielded no results. On April 15, a single-judge Justice Saurabh Banerjee will hear the case.
Previously, Sai Deepak, representing Tesla Power, cited that Tesla is not a unique trademark as there are other companies and registrations with this name in India, and other countries.“Therefore, for someone to come out and say that because of Elon Musk, we are the only ones who are entitled to claim Tesla and a monopoly over it, frankly speaking, doesn’t fly”
