What is the fundamental right that is being violated? Not at the behest of political parties. This is not the platform. You go to the high court,” the bench said.The top court said if hawkers are encroaching, they will be removed and in case there is any violation of law by authorities, the petitioner can go to the High Court.
Earlier in the day, protests erupted in Shaheen Bagh on Monday with hundreds of people, including women, opposing the SDMC’s anti-encroachment drive as bulldozers rolled into the area in the presence of heavy police personnel. Following the protest, the SDMC officials, who were part of the anti-encroachment drive, returned with bulldozers without conducting the exercise, an official said. Protesters raised slogans against the BJP-ruled South Delhi Municipal Corporation (SDMC) as well as the central government and demanded that the action should be stopped. Some women protestors also stood in front of bulldozers to prevent the exercise.

Delhi BJP Chief Adesh Gupta criticised the Congress and AAP for “opposing anti encroachment drive” in Shaheen Bagh.
“Today it's proved that AAP and it's MLAs are supporting Rohingyas and Bangladeshis. Those who are lying before bulldozers will be given a reply by the people. It's unfortunate that AAP and Congress are opposing removal of encroachment in Shaheen Bagh. I urge AAP and Congress not to link encroachment with religion,” he said.
The anti-encroachment drive at Shaheen Bagh has been halted. It remains unclear whether the drive will resume, reports The Indian Express.

Parvez Alam of the Congress was detained for protesting in front of the bulldozer in Shaheen Bagh. He said, “The MCD is the world's most corrupt corporation. Aaj Mayor ko istifa dena chahiye uske nikammepan par. Adesh Gupta ke ishare pe kaam kar rahe hain. (The Mayor should resign today over his uselessness. He functions according to BJP leader Adesh Gupta).”

The drive, which began on May 4, will continue till May 13 in different localities, SDMC chairman, Central Zone, Rajpal Singh told PTI last week. The drive will cover areas such as the Shaheen Bagh main road, Kalindi Kunj, MB Road, Meharchand Market, Sriniwas Puri and Khada Colony, he said.
“We have prepared a 10-day action plan to remove encroachment from these areas, including Shaheen Bagh. We have also asked for adequate police force to carry out the drive. We will start the drive in Shaheen Bagh on May 9,” Singh told PTI.
An anti-encroachment drive conducted by the North Delhi Municipal Corporation in Jahangirpuri area, which witnessed violence between two communities on April 16, had drawn widespread criticism. The Supreme Court had to intervene to stop the demolition drive there.
