The name of Sunjay Kapur’s sister Mandhira Kapur has been dropped as a party to the 3,000 crore inheritance battle for late businessman Sunjay Kapur’s estate.

The Delhi High Court on Friday has taken action in favour of application filed by Kapur’s wife, Priya Kapur against the appearance of Sunjay Kapur’s sister Mandhira Kapur as a party to the case.

The court said that its order in the Sunjay Kapur estate dispute matter will be rectified to the extent that it recorded the presence of lawyers appearing for his sister, Mandhira Kapur, according to Bar & Bench.

Justice Jyoti Singh allowed an application filed by Priya Kapur objecting to Mandhira’s appearance as a party to the case. The court had recorded the presence of lawyers for Mandhira, even though she had not been impleaded.

“That upon the careful perusal of the Case History of the captioned suit from the website of the Hon’ble High Court of Delhi it is apparent and clear that Ms. Mandhira Kapur has not filed any application to be impleaded as a party to the captioned suit, and therefore the said deliberate and mischievous attempt is to gain a back door entry into the proceedings before this Hon’ble Court and take a benefit out of the present lis,” Priya’s plea as quoted by Bar & Bench read.

Priya’s plea added that Mandhira’s attempt to join the proceedings is “an abuse of process of law.”

“It is pertinent to note that the manner in which Ms. Mandhira Kapur has attempted to join the proceedings is unknown to the law, and is an abuse of process of law in an attempt to create an incorrect record on the record of this Hon’ble Court,” the application said.

How it all started

The Delhi High Court had recorded Priya Kapur’s lawyer’s appearance on September 10 while hearing a plea filed by Karisma Kapoor’s two children seeking a share in their father’s estate.

Kapoor’s kids Samaira and Kiaan, represented by their mother, approached the Delhi High Court seeking share in their father’s wealth.

They alleged that their stepmother Priya Kapur forged the will to gain complete control of his assets after his sudden death in UK while playing golf.

Mandhira has spoken in support of Kapur’s kids expressing her disbelief over their father leaving them out of his will.

“I stand by them because I do not think that if anyone knows the relationship they have had with their father and for their father not to have them a part of the will, it just doesn’t add up. Doesn’t make sense. So I stand by them,” she was quoted as saying by news agency ANI.

Court directs Priya Kapur to submit details of her late husband’s assets

On September 10, High Court had directed Kapur third wife Priya to submit details of all his assets.

Seeking rectification in the order recording the presence of lawyers for Mandhira, Priya Kapur along with her minor son, argued that the lead counsel representing Mandhira had not been present in court and not had they made any submissions when invited to by the Bench.

Priya also alleged in the plea that Mandhira attempted to gain “a backdoor entry” into the proceedings and called it a “mischievous attempt to mislead the court.” The plea added that such an intervention was “neither permissible nor legally valid” and amounted to an abuse of legal process.

Karisma Kapoor and Sunjay Kapur were married between 2003 and 2016 and are parents to two kids – Samaira and Kiaan.
