In a big step, the Maharashtra government has allowed the establishments in the state to operate 24 hours a day, to boost business and enhance the experience of night-life for the people. The order, issued by the Industries, Energy, Labour and Mining Department through a circular, mentioned that all the shops to operate 24×7.
The only exception are businesses that serve alcohol like permit rooms, beer bars, and wine shops, reports said.
The decision comes at a time when many locals were complaining about police personnel and authorities troubling them from operation in the night.
What is the requirement?
According to circular, one of the key requirements for these businesses and establishments to function full day is that they must ensure that each of their employees get one weekly break of 24 consecutive hours. This is part of the Maharashtra Shops and Establishments Act, 2017.
The 2017 law regulates the working conditions and rights of employees in commercial establishments across the state of Maharashtra. According to an Indian Express report, Section 2(2) of the Act defines a “day” as 24 hours beginning at midnight. The government has clarified that “subject to weekly off provisions, all establishments other than those serving or selling liquor are permitted to remain open 24×7”.
Instructions for local administration
The state government has also asked police departments and local administration to ensure proper implementation of the law. Moreover, it has now removed the timing cap on theatres, allowing them to function as per their choice, further boosting the businesses for shops.
The decision is likely to increase the earnings of shop owners, especially during the festive season this month.
