Delhi BMW case: Delhi Police arrested Gaganpreet Kaur on Monday in connection with the fatal BMW crash that took the life of Finance Ministry official Navjot Singh. After a medical examination, she was produced before the court and sent to a two-day judicial custody. Gaganpreet has denied all charges related to the Dhaula Kuan accident.
‘CCTV footage not provided in court’
Her lawyer, Vikas Pahwa, responded to allegations that the injured were taken 45 minutes away to Neulife Hospitals in GTB Nagar. He dismissed claims of malicious intent, stating that Gaganpreet had called the hospital in advance to alert them and prepare for the emergency.
“As per the taxi driver, the doctors treated them properly. They reached the hospital within 46 minutes, and at around 2.16 AM. He (Navjot Singh) was declared brought dead,” Pahwa added.
‘FIR contradicts police presser’
He also pointed out inconsistencies between the presser by the Delhi Police and the FIR. Pawha said that DCP himself acknowledged that the accident occurred after the BMW swerved at a sharp turn, initially hitting Singh and his wife, Sandeep Kaur, before their bike was hit by a bus on the left side during the impact.
He also claimed that the police failed to present the CCTV footage in court and questioned how this case could be classified under Section 304 (culpable homicide not amounting to murder).
“If someone dies because of rash and negligent driving, then it is a bailable offence. If someone tries to turn it into a non-bailable offence by adding certain sections, it is unfortunate,” he told ANI.
‘Not an accident of two minutes’: Victim’s lawyer
Victim’s lawyer, Ishan Dewan, said that it is not an accident of two minutes but a couple of hours. “The decision they took was not to take the victim to a hospital, which was a minute away; instead, he was taken far away. This shows their mental and decision-making condition,” Dewan said.
He added that they would present all facts in court and stressed that such incidents should not happen again.
Delhi BMW crash: Dhaula Kuan accident
Gaganpreet, her husband, their two children and a house help were in the BMW when it rammed into Navjot Singh’s bike and claimed his life. His wife is undergoing treatment in a hospital in Dwarka.
The couple had visited Gurudwara Bangla Sahib and were returning from Karnataka Bhavan on Sunday afternoon when the incident happened. Delhi Police is awaiting the results of blood tests following allegations that the woman was intoxicated.
During interrogation, Gaganpreet claimed she could not remember how the incident happened and only recalls people pulling her from the vehicle afterwards.
On the other hand, Navjot Singh’s wife has alleged that despite her repeated pleas to be taken to a nearby hospital, the couple in the BMW ignored her and instead transported them to what she described as the “worst nursing home”.
Their family has also alleged that the delay and distance in reaching proper medical care cost Navjot Singh his life.
The accused’s lawyer opposed the judicial remand, citing a 10-hour delay in filing the FIR. A bail application for Gaganpreet Kaur has been submitted, and the court has issued a notice to Delhi Police. The bail hearing is scheduled for September 17, and she will be produced in court on the next date.
