Setting aside an order by Patiala House court, the Delhi High Court on Tuesday said that Aam Aadmi Party MP Raghav Chadha can stay in his government bungalow and would not have to vacate it.

A single bench of Justice Anup Jairam Bhambhani revived the city court’s April 18 order of restraining the secretariat from disposses sing the MP from the bungalow till adjudication of his application seeking a temporary injunction against eviction.

The court has directed Chadha to approach the city court within three days with his application for interim relief and has directed the trial court to first decide on the same in accordance with law.

Chadha had challenged the trial court’s October 5 order which vacated the April order. The court had said in its latest order that Chadha cannot claim an absolute right to occupy the government bungalow during his entire tenure as a Rajya Sabha MP even after cancellation of allotment.

Chadha’s counsel had submitted before the high court that the MP has been served with a notice and eviction proceedings are going on.

The Rajya Sabha secretariat had opposed his petition against the trial court’s decision.

The MP’s allotment to a Type-VII bungalow in Delhi’s Pandara Road was cancelled by the Rajya Sabha Secretariat in March. He was told that the allotment had been cancelled as Type-VII was higher than his entitlement as a first time MP and he was allotted another flat.
