Nestle India on Wednesday asked the National Consumer Disputes Redressal Commission to recall its earlier order allowing the government to collect samples of its popular Maggi noodles and test them in its labs.

In its plea, Nestle India said that earlier test findings conducted by the Food Safety and Standards Authority of India, were already dismissed by the Mumbai High Court. While the food authority is seeking to conduct more tests, its laboratories are not accredited for testing such products, it said.

Following its plea, Justice VK Jain heading the National Consumer Disputes Redressal Commission, asked the government for its response.

Separately, the commission also asked Nestle India for its response on a government plea that has sought to include the FSSAI as a party in the dispute, since the authority did not challenge an earlier order of the Mumbai High Court on the issue.

The case will now come up for hearing on October 8.
