The National Consumer Commission has refused to direct the Andhra Pradesh Housing Board to allot a flat in favour of an advocate after he failed to comply with the directions of a lower forum which had ordered payment of 50 per cent of its total cost.
“Instead of paying the said amount, the petitioner kept on delaying the payment by filing some application or the other. It is crystal clear that he has not fulfilled his part
of the conditional order to deposit of 50 per cent of the
total cost and is not entitled to enforce the conditional
direction given in absence of non compliance,” the Commission
said.
The Commission bench, comprising Members K S Gupta and R K Batta, passed the order on a petition filed by advocate Nagender seeking directions to the board to allot the flat.
The board contended that the District Forum in Karnataka had disposed off the matter with the directions in 2007, saying that unless the condition attached to it got fulfilled, the complainant could not get the allotment.
Nagender failed to pay the full amount as called for and dragged the matter on one pretext or the other, the board argued before the National Commission.
The Karnataka State Commission had also dismissed the revision petition filed by him in 2008 following which he had approached the apex consumer body.
