Aarushi murder case: A day after he told a Ghaziabad court that dentist couple Rajesh and Nupur Talwar were the killers of their daughter Aarushi and domestic help Hemraj, CBI Superintendent of Police A G L Kaul on Wednesday said he had not named Rajesh?s brother Dinesh Talwar as a witness while filing his final report as he was then seen as a possible suspect.
Kaul made the statement in the court of Additional Sessions Judge Shyam Lal where the Talwar couple are being tried for the twin murder in May 2008.
In December 2010, Kaul filed his final report naming Rajesh as the main suspect, but said there was insufficient evidence against him and, therefore, the CBI had decided to close the case. But a special CBI court rejected the closure report and made Rajesh and Nupur co-accused in the case in February 2011.
On Wednesday, Kaul told the court: ?Based on K K Gautam?s account to me that he got a call from Dr Sushil Choudhary who asked him if it was possible to remove mention of rape from the post-mortem report, I mentioned it in my final report. Dr Choudhary had reportedly told Gautam that he got a call from Dinesh Talwar who asked him to call Gautam to see if he (Gautam) could help. I had made K K Gautam, Dr Sushil Choudhary, and Dinesh Talwar sit in the same room in a ?confrontation?, but this was not videographed. At that time, when I put forth my final report, Dr Sushil Choudhary and Dr Dinesh Talwar were possible suspects, which is why they were not listed as witnesses.?
During his testimony as prosecution witness, Gautam, former DSP of Noida Police, had said he got a call from Dr Choudhary who in turn had been contacted by Dr Dinesh Talwar to help remove mention of the word ?rape? from the post-mortem report. Choudhary had also sought his help to speed up the post-mortem examination on Aarushi?s body, Gautam had said.
During cross-examination by the defence counsel on the allegation that the Talwars dressed up the crime scene, Kaul said there was no scientific report to show that bloodstains were removed from the stairs leading to the terrace.
?In no report has it come out that bloodstains in any part of L-32, Jalvayu Vihar (the Talwar residence) were wiped off,? he said.
Questioned on the fingerprints, Kaul said, ?I wrote in page 17 of my report that on no object in the house were there fingerprints of family members in the house. I wrote in page 30 of my report that the fingerprints on the Ballantine?s Scotch bottle could not be identified.?
