The Supreme Court recently issued a decision on the puzzling problem of car registration transfer to a new owner. The Supreme Court has addressed the process of car ownership transfer and whether the original owner can be held liable if the new owner fails to transfer the vehicle under their name despite having completed all of the documentation. We will clarify the Supreme Court’s observation and explain how to transfer automobile ownership.
Previous vehicle owners cannot be penalised for buyer’s error
The case came to light in 2019 when the Gauhati High Court ruled that Arunachal Pradesh’s MLA Karikho Kri failed to mention three automobiles owned by him and his family members when filing his election nomination. After reviewing the facts, the Supreme Court determined that even after selling the vehicles, the registration was not transferred to the new owner’s name under the Motor Vehicles Act 1988. According to a source, the Supreme Court overruled the prior decision, ruling that a candidate has the right to privacy and that non-disclosure of any movable asset is corrupt activity.
The Supreme Court observed that the former owner had completed the entire process of transferring ownership and paperwork for the vehicles. As a result, the new owners are responsible for registering the vehicles in their name. As a result, the former owner of the vehicles cannot be penalised for any irregularities during the registration procedure.

Vehicle registration transfer within the state
- Collect Form 29 and Form 30 from the nearest Regional Transport Office (RTO)
- Fill out the forms with the original vehicle owner’s signature
- Submit the forms, the registration certificate, insurance, pollution under control certificate (PUC), and address proof of both the buyer and seller to the RTO
- Pay the fees for registration transfer ownership
- New registration is issued by the RTO after verifying the documents
Interstate vehicle registration transfer process
- Fill up Form 28, Form 29, Form 30 and Form 33 from the RTO where the seller is based out
- No Objection Certificate from the RTO where the vehicle is originally registered
- Submit the forms with the original car owner’s signature, registration certificate, insurance, PUC and address ID of the buyer and the seller to the RTO where the vehicle is originally registered

- Registration certificate transferred under the buyer’s name
