TVS Motor backs out of patent row

After fighting a pitched battle against rejection of a patent regarding an ‘invention’ on fluorescent-made self-locating ignition lock assembly in motor vehicles, the Chennai-based two wheeler major TVS Motor Company has withdrawn the appeal filed at the Intellectual Property Appellate Board (IPAB)- the appeal tribunal for patents and trademarks.

In a dramatic turn of events, M K Rao, the counsel for TVS Motor Company informed the IAPB when it took up the matter on Monday that his client was not any more interested to pursue the matter and sought to withdraw the appeal.

In a statement to FE, the company said that it would continue to provide the feature where ever it is appropriate and others can also benefit from the claimed invention.

“TVS Motor has decided not to pursue the appeal further for the subject application for grant of a patent which would provide exclusive rights. TVS Motor may continue to provide this feature where ever appropriate and equally others can benefit by incorporating the feature of illumination of ignition lock assembly on two wheelers during night,” a TVS spokesperson said in the statement.

The IPAB bench consisting of chairman Justice K N Basha and DPS Parmar, technical member, patents, while taking into consideration the written endorsement made by the TVS Motor Company counsel, ordered that the appeal has been dismissed withdrawn as was not pressed.
