The Cellular Operators Association of India (COAI) on Wednesday said the Telecom Regulatory Authority of India (Trai) has misinterpreted the licensing rules while issuing order prohibiting differential pricing for data services, as it urged the regulator to review its February order in this regard.

By raising the illegality of the order, COAI has hinted that if the regulator does not review its order, it might challenge it in the court.

Trai has “inadvertently mixed up the unrestricted physical or technical access with non-discriminatory commercial access”, while citing a clause in the Unified Licence and Internet Service Providers terms and conditions while issuing the order prohibiting differential pricing of data services, according to the COAI.

Rajan S Mathews, director-general of COAI, has written to Sudhir Gupta, secretary, Trai, seeking a review of the order.
