Congress President Rahul Gandhi on Tuesday said that Sohrabuddin Sheikh case has ‘claimed’ yet another judge. He also referred to the issue of death of CBI judge BG Loya, who was earlier hearing the case and used the hashtag “#HowDidLoyaDie?” with his tweet. “The Sohrabuddin case claims yet another Judge. Justice Revati Dere, who challenged the CBI has been removed. Judge J T Utpat, asked Amit Shah to appear and was removed. Judge Loya asked tough questions. He died. #HowDidLoyaDie? (sic),” he tweeted. The Congress chief also cited media reports, saying the judge has been replaced.
As per a Press Trust of India report, a notice published on the high court website said that Justice Revati Mohite-Dere will no longer hear applications on the case. However, apart from Justice Mohite-Dere, the assignment of cases of some other judges were also changed.
Justice Dere was hearing a batch of petitions challenging the discharge of some senior IPS officers in the alleged fake encounter case of Sohrabuddin Shaikh. Shaikh, an alleged gangster with terror links was killed along with his wife Kausar Bi in a suspected fake encounter by the Gujarat police in November 2005. In 2006, Shaikh’s aide Tulsiram Prajapati was killed in another alleged fake encounter by the Gujarat and Rajasthan police. BJP chief Amit Shah, who was the then home minister of Gujarat, was among 15 persons given clean chit by the CBI court in Mumbai between August 2016 and September 2017.

Meanwhile, in another related development, Delhi High Court put on hold a direction of BCI asking Gujarat bar council to start disciplinary proceedings against senior advocate Dushyant Dave. Dave had allegedly made statements regarding the death of Special CBI Judge BH Loya. Justice Loya, who was hearing the high-profile Sohrabuddin Shaikh fake encounter case, had died allegedly of cardiac arrest in Nagpur on December 1, 2014. The Congress President has been raking up the issue of Justice Loya’s death time and again. Gandhi has also demanded probe in the matter a number of times.
