Last week the Supreme Court deemed instant triple talaq (talaq-e-biddat) unconstitutional. The historic judgement came on August 22 which gave all Muslim women in India the freedom from instant triple talaq. However, the very next day, a woman was divorced by her husband through triple talaq. Dilshad Fatima was allegedly beaten up by her husband, who wanted dowry, and a male child, as per the report by the Indian Express. Since May, she was shuttling between her husband's and her brother's home which is located 30 metres away. On the afternoon of August 23, Fatima's family alleged that her husband reached her brother\u2019s house where she was living with her daughters and said \u2018talaq\u2019 thrice before leaving. Fatima\u2019s elder brother, Anwar was quoted as saying that the couple had three daughters but the husband wanted a son, which led to problems. "The eldest child died five days after she was born. Masoom Zahra (10) and Dilnaz (8) live with their mother and my brother,"Anwar said. He added, "He wanted Rs 5 lakh and a car. We had been trying to support them financially. We came to know about the physical violence after a long time. Our only concern now is the future of the children." As per the report by Indian Express, on the basis of a complaint filed by Fatima, on Wednesday an FIR against her husband was registered. The SHO of Jharcha police station, Shailendra Pratap Singh, said that a case has been registered under IPC sections 498A, 323, 504 and 506. Section 3\/4 of the Dowry Prohibition Act has also been added. The police said said that 13 years ago, Fatima had married the man who runs a business in brass products.
