No relief for DND flyway commuters; here’s why

The Supreme Court on Thursday refused to stay collection of toll tax on DND Flyway connecting Delhi and Noida, but asked the Allahabad High Court to decide on the said PIL within three months.

The Supreme Court on Thursday refused to stay collection of toll tax on DND Flyway connecting Delhi and Noida, but asked the Allahabad High Court to decide on the said PIL within three months.

Refusing to restrain the Noida Toll Bridge Company (NTBCL) from collecting toll tax on the DND flyway, a bench headed by Chief Justice TS Thakur without expressing its opinion on the merits of the case directed the HC to dispose of the matter within three months.

The Noida Toll Bridge, a special purpose company, is the first green-field private toll bridge and road network project implemented in the country, formed for this purpose.

Petitioner Federation of Noida Residents Welfare Association in its PIL said in spite of the HC giving 70 hearings on the PIL, its application seeking stay on collection of toll was ignored altogether. It argued that while the project cost was
Rs 407.6 crore in November 1997, the concessionaire has already recovered the cost and also made a profit of Rs 581 crore till December 2012.

Even the firm’s own audit report, prepared by SN Dhawan & Company, its chartered accountants, says so, it said, adding that the public is still being harassed to pay the toll tax for using the flyway.
