Pune rape case: The man who raped a girl, was caught, and was looking at spending years in jail for his crime has gone free in an unusual twist of fate. The rape case against a 30-year old man was quashed by the Bombay High Court, giving him great relief. The Bund Garden police in Pune had filed an FIR on June 6, 2016 charging the man under the IPC pertaining to rape (section 376) and causing hurt (323).
The 23-year-old girl, who is 7 months pregnant, was paid Rs 10 lakh. With the court saying it was being done under “special circumstances” and that too with the girl’s consent. The court said that the money paid should be kept in a fixed deposit (FD) in a public sector bank for 10 years. The girl would be entitled to the interest earned on the sum and at the end of the term she would be eligible to withdraw the amount, said the court.
The case stemmed from an FIR lodged by the girl that the accused had raped her after promising to marry her. The court said, “We are quashing the complaint under special circumstances as the victim has consented to this and the accused has deposited Rs 10 lakh to secure her future and the unborn child.”
More than that, the crux of the case revolved around one fact that was highlighted by the court that, “The records revealed that both were in consensual relationship”.
The complainant told the court that she had no objection to the complaint being quashed and that she would like to settle the matter. The man had already deposited Rs 5 lakh with the High Court Registrar.
The girl told the court that the FIR filed against the accused was due to a misunderstanding. She said that she knew that the accused was married. This backed the man’s lawyer Rakesh Bhatnagar’s argument that the relationship between the two was consensual and the couple had reached a settlement.
