In a major development which comes as a setback for the Kerala police, the Ernakulam Chief Judicial Magistrate has ordered that the main accused Pulsar Sunil and Vigeesh must be immediately produced in court. This move signals a major setback for Kerala police and it is being seen as the court’s intervention because the cops had used force to take Pulsar Sunil from the courtroom premises.
Earlier, several lawyers had also pointed out that if a person is surrendering in court, the police do not have a right to forcibly take the said person into custody. It amounts to disrespect shown to the jurisdiction of the court. The legal stance is that when anything happens in court premises, whether or not a magistrate is presiding over court, it falls within the court’s jurisdiction.

However, this afternoon, the police forcibly took Pulsar Sunil and Vigeesh into custody from the court premises. Lawyers had initially tried to resist the cops from using force to take them into custody but the cops used the excuse that the magistrate is having lunch and the courtroom without a magistrate is only a room!
At 1.20 PM, the main accused in this case Pulsar Sunil had come to court to surrender and he had not been detected till he entered court. From court premises, he was forcibly dragged by the police and taken into their custody. This move has now come under the court’s radar.
