The Delhi High Court on Monday waived Rs 75,000 cost previously imposed on a law student for filing a public interest litigation (PIL) seeking ‘extraordinary interim bail’ for Chief Minister Arvind Kejriwal.

This decision followed the student’s unconditional apology and his assertion that he has learned his lesson.

Representing the petitioner, the counsel informed the court that his client, a student with no earnings, had understood the judicial system through this experience. “I learnt my lesson well. Please consider my situation,” the petitioner’s lawyer pleaded.

In response to these submissions, a division bench of Acting Chief Justice Manmohan and Justice Manmeet P S Arora stated, “Costs of Rs 75,000 imposed on the petitioner is waived.”

On April 22, the court dismissed a public interest litigation seeking “extraordinary interim bail” for Aam Aadmi Party (AAP) leader Arvind Kejriwal, who was in judicial custody in a money-laundering case related to an alleged excise scam.

The petitioner had listed his name as “We, the people of India” in the plea, insisting that he was not seeking personal gain from the matter. However, the court deemed the petition “totally misconceived”, noting that Kejriwal had the resources to pursue legal remedies independently and that the petitioner lacked the authority to make statements on his behalf.

Kejriwal’s counsel also opposed the PIL, stating that Kejriwal could pursue legal remedies on his own.

The petitioner’s counsel argued for Kejriwal’s release on several grounds, including concerns for his safety in jail with hardcore criminals. He also argued that Kejriwal’s absence was hampering decision-making in the Delhi government.
