The advisor to Delhi Chief Minister Arvind Kejriwal, VK Jain has made multiple statements that he saw Delhi Chief Secretary Anshu Prakash being assaulted on February 19. While talking to the police, Jain said that he saw Prakash’s “spectacles fall off”. As per the report in The Indian Express, Jain contradicted his earlier stand on the incident where he said that he was present at the meeting however, he was in the “washroom” for a few minutes and denied witnessing the assault.
During the court hearing of two AAP MLAs who were arrested for assaulting Anshu Prakash on Thursday, Jain made the statement to a Delhi court. The second statement was made under Section 164 of the Code of Criminal Procedure (CrPC) before a magistrate.
On Thursday, Atul Srivastava, the Additional Public Prosecutor talked to Shefali Barnala Tandon, Metropolitan Magistrate and said that Jain’s statement was recorded before police. Srivastava said, “In Jain’s statement under Section 161 of the CrPC, he said that he left his home in Maharani Bagh around 11.30 pm and arrived at the Delhi CM’s house at midnight.”
As per the prosecutor, the statement by Jain mentions that he has admitted that he witnessed the assault after he exited the washroom. Srivastava to the Court said, “VK Jain saw two AAP MLAs had surrounded Anshu Prakash and were assaulting him. This is when his spectacles fell off.”
BS Joon, the defence counsel for the two AAP MLAs, highlighted the difference in Jain’s statements. A fresh application was filed by the prosecution during the hearing. The application mentioned that the two MLAs bail must be opposed. The court has now reserved the order on bail for Friday. Both the MLAs have been sent to judicial custody for 14 days.
Under 164 CrPC, Jain’s statement stated: “After coming from the washroom, I witnessed that the two MLAs Amanatullah Khan and Prakash Jarwal were sitting and were ‘physically assaulting’ Delhi Chief Secretary Anshu Prakash. They were asking why are you not working. Both of them were pushing him, physically touching him and were threatening him after pressing his chin. Following this incident, his spectacles fell.”
