The Supreme Court (SC) has issued bailable warrant against Justice C S Karnan today for his failure to appear before it in a contempt case.
The Supreme Court (SC) has issued bailable warrant against Justice C S Karnan today for his failure to appear before it in a contempt case. Bailable warrant was issued after Calcutta HC judge CS Karnan refused to appear before SC to face contempt charges despite apex court’s notice. SC has refused to consider Justice Karnan’s letter as his reply to contempt notice. Apex court said Justice Karnan will have to furnish a personal bond of Rs 10,000 to secure bail in the contempt case. Earlier, on February 8, in an unprecedented order, the Supreme Court had asked sitting Calcutta High Court judge Justice C S Karnan to appear in person before it and explain as to why contempt proceedings be not initiated against him and forthwith restrained him from undertaking judicial and administrative work. This is the first time that the top court of the country has issued a contempt notice against a serving judge of another court.
“Issue notice to Justice C S Karnan. Returnable on February 13. Shree Justice C S Karnan shall forthwith refrain from handling any judicial or administrative work as may have been assigned to him,” a seven-judge bench headed by Chief Justice of India J S Khehar had then said.
“He is also directed to return all judicial and administrative files in his possession to the Registrar General of the High Court immediately,” the bench also comprising Justices Dipak Misra, J Chelameswar, Ranjan Gogoi, M B Lokur, P C Ghose and Kurian Joseph said. It said, “Shree Justice C S Karnan shall remain present in person on next date to show cause.”
