The Election Commission of India, will hear the case against the 21 AAP MLAs against whom a petition was filed alleging that the legislators occupied offices of profit in violation of the Constitution. The 21 MLAs and all others concerned with the case will be provided a chance to put forward their case.
The ECI had earlier issued a show-cause notice to the 21 legislators who were appointed as Parliamentary Secretaries by the Delhi government on March 14 last year.
The President of India had withheld the Delhi government’s dual office bill, It was alleged that the 21 MLAs appointed as Parliamentary Secretaries were not legally allowed to continue in office.
A BJP leader had filed a complaint with the president of India calling for the disqualification of these 21 parliamentary secretaries.
The list includes prominent AAP legislators such as Dwarka MLA Adarsh Shastri, Rajouri Garden MLA Jarnail Singh and Tilak Nagar MLA Jarnail Singh and also two women MLAs, Alka Lamba and Sarita Singh.
In abid to shield the MLAs from being disqualified the AAP government had passed a bill in the state assembly exempting parliamentary secretaries from the ambit of the dual office of profit law, with retrospective affect.
The orders were accompanied by a statement from the AAP government saying the Parliamentary Secretaries would “not be eligible to any remuneration or perks of any kind, and hence will not be a burden on the exchequer.”
The AAP said that this is a conspiracy by the BJP. AAP has 67 MLAs so this might not affect the government as such.
