The Madurai Bench of the Madras High Court has pulled up a Village Health Nurse for fighting three rounds of litigation on a transfer issue.

Justice K Chandru, dismissing a petition filed by the nurse, Sivagami, who was working with Tirupalaikudi Primary Health Centre, said he was shocked that the ordinary post of primary Health Nurse was being hotly contested between her and another nurse, C Shanthi.

The petitioner and third respondent Shanthi have been continuously approaching the Court over the transfers issued on three occasions. They were wasting the precious time of the court. "It is also not understandable as to how they have such a wherewithal to contest the transfer order issued more than three times," he said.

The attempt of the petitioner to file the writ petition time and again over the same issue was nothing but taking the court for a ride. "It is a clear abusive process of law and no legal issues are involved" Justice Chandru said.

The Director of Medical and Rural Health Services (DMHRS) had transfered Sivagami from Tirupalaikudi to Ramanathapuram on February 4, 2006 on her request. Though Shanthi challenged this order, it was dismissed. She was asked to make a separate representation to the DMRHS for grievance (Transfer).
