It so happened that the song 'Sharabi' was sung by Manj, brother of Surj and another member of RDB gang. RDB, a popular Punjabi rap band was dissolved after the death of Kuly (Kuljeet Ral), post which brothers Manj and Surj decided to part ways. While currently the band is headed by Surj solely, the song in 'Happy New Year' was sung by his brother Manj. The music for the film was composed by Vishal - Shekhar. However, what left Surj miffed was the fact that he wasn't given credit for this track which was composed when he and Manj were a part of RDB.
From what we hear, the song was sold to music composer duo Vishal-Shekhar by Manj with fraudulent documents. Hence, this created a sort of copyright infringement and now, Three Records & RDB has sent a legal notice to Red Chillies requesting the song to be removed from the film or the correct credits to be replaced.
Surj said, "It's a real shame that this film has been caught up within the split of me and Manj. As the remaining lead member of RDB, we continue to perform our new and old hits regardless of other people claiming ownership. Despite this small portion to the film, I wish SRK (Shah Rukh Khan) and the HNY (Happy New Year) its deserved success."
However, as of now, Red Chillies hasn't responded to the notice effectively. Though they had agreed to resolve the issue, no productive solution has been given as yet. Hence, now, Surj and his associates (Three Records) have filed a case against Happy New Year for damages.
Directed by Farah Khan, Happy New Year stars Shah Rukh Khan, Deepika Padukone, Abhishek Bachchan, Sonu Sood, Boman Irani, Vivaan Shah and Jackie Shroff. The film released on October 24.
