It has done so in the wake of CERCs order in this regard. REPTL, which had filed its application for inter state power trading license under section 15 (1) of the Electricity Act (EA) 2003, had been asked to file copies of the public notice of each of the newspapers, to CERC on affidavit, within seven days of their publication. CERC has convened next hearing on this matter on November 4 this year. RETPL sources told FE that it has complied the CERC order and published notice in this regard. Sources, however, said that RETPL had made a plea for granting a provisional license for inter state trading on the lines of PTC till the regular license was granted. CERC chairman AK Basu and its member KN Sinha in their order of September 17 had observed that the REPTL, as required under sub section (2) of section 15 of EA 2003, had not so far published the notice.
RETPLs JP Chalasani had submitted that the notice could not be published since the particulars and manner of publication of the notice have not been specified by the CERC as yet. CERC added, it was currently in the process of specifying the technical requirement, capital adequacy requirement and creditworthiness for undertaking inter state trading in electricity. CERC said, while doing so, it would also specify other related matters, such as the particulars and the manner in which notice for the grant of license in inter state trading application was to be published. It is, however, likely to take some time before these are actually notified. At the same time, it is not desirable to keep the application pending, thus we direct the petitioner to publish notice, CERC said.
