Kerala HC dismisses Coca-Colas petition

The Kerala High Court on Thursday dismissed a clarification petition filed by soft drinks major Hindustan Coca-Cola Beverages Ltd seeking a direction that they have deemed licence to restart their bottling plant at Plachimada since the panchayat had not renewed their licence despite the court order of June 1 this year.

A division bench, comprising Justice M Ramachandran and K P Balachandran, held that since the panchayat had granted renewal of licence for three months, it cannot be said that the company had deemed licence.

The petitioner had sought clarification of the courts order of June 1 this year directing the panchayat to grant licence to the company for a limited period. The petitioners had sought renewal of licence for a two-year period.

The Perumatty panchayat, where the Cola plant is located, had objected to the clarification petition, contending that the company was misusing the process of court and the application was mischievous.

The bench observed that although the affidavit filed by the panchayat President contains allegations and per se discloses bad taste, it was not concerned with such irrelevant murmurings.
