Mumbai, Feb 22: Marking the latest move in Procter & Gamble Hygiene and Health Care's (P&G) crusade against counterfeit products, is legal action against `Hair & Showlers' - a look-alike of Head & Shoulders shampoo - and another infringing product `Vikas Cough Drops', an imitation of Vicks cough drops.The court receiver in Ahmedabad had raided the premises of Raj Remedies and seized large quantities of infringing product `Vikas Cough Drops'. P&G had earlier filed contempt proceedings against Raj Remedies as it was continuing to sell `Vikas Cough Drops' despite injuntion orders, the company said.
On `Hair & Showlers', P&G has got an order for appointment of a commissioner who is empowered by the Ahmedabad city civil court to seize any infringing product from the market. Pursuant to this order, the company said, the court receiver has seized infringing products from some wholesalers.
P&G has kicked off a drive against look-alike product manufacturers in the last few months. Deceptive counterfeit products with similar packaging and colours in the market place have not only duped consumers into believing that these are genuine products of well-known brands, but have also affected the company's sales.
Previously, the company's drive led to similar raids being conducted in some parts of Mumbai where counterfeit products of the company's brands were seized.
Under the Drugs and Cosmetics Act, 1940, Section 17-B a drug/cosmetic is ``deemed to be spurious if it is an imitation, or is a substitute for, another drug or resembles another drug in a manner likely to device or bears upon it or upon its label or container the name of another product unless it is plainly and conspicuously marked so as to reveal its true character and its lack of identity with such other drug.''
