Task force to book 15 erring companies in AP

Hyderabad May 25: The inter-departmental task force set up to bring vanished companies to book has identified 15 units in the AP region, which have garnered huge monies from the capital markets and allegedly disappeared.

The regional task force of Sebi, the registrar of companies (ROC) and the HSE, which met in Hyderabad recently to work out the modalities for moving against them has decided to register cases against the erring companies.

The companies include Vini Meta Spin, Prism Foods, Rank Industries, Electro Flame, Raghunath Cotton Products, EBF Finance, Aditya Alkalides, Aqua Dev, Kamakshi Housing and Premier Aqua.

Cases against these companies are to be filed under various sections of the Companies Act 1956 including sections 146, 159, 166, 210, 220 and 209 A, which pertain to various offences ranging from non-submission of annual returns to not conducting the AGM and failure to intimate change of addresses to the respective RoCs.

Meanwhile, Sebi will be calling for information on thesecompanies from intermediaries like merchant bankers, financial institutions and registrars, using the provision under section 12 B of the SEBI Act.

The recent meeting of the task force also decided to utilise the manpower of the HSE to carry out physical verification of address of the companies and books of accounts, the sources said.

RoC officials said that the task force meeting also decided the evaluation process will be carried out simultaneously by the three agencies and the final report prepared for the next meeting. According to RoC sources, 102 companies from out of 450-odd registered with it have not filed either their balance sheets or annual accounts, nor have they conducted annual general meetings over the last two to three years.
