Calcutta, Oct 26: A Calcutta high court bench on Monday opted out of the hearing into appeals by Shaw Wallace & Co Ltd and its Dubai-based chairman Manu Chhabria against the Company Law Board's July 27 order, following objections raised by the company's counsel Anil Diwan.The division bench of justice Ruma Pal and justice B Panigrahi was to hear four separate appeals -- SWC versus Union of India, SWC versus All India Shaw Wallace Employees' Ferderation, Manu Chhabria versus Union of India and Manu Chhabria versus All India Shaw Wallace Employees' Federation.
But Diwan pointed out to justice Pal that, in a related case of the company, her husband S Pal had appeared on behalf of S Sarker, the counsel for respondent All India Shaw Wallace Employees' Federation who was made a party in that case.
On hearing this, justice Ruma Pal released all the four cases relating to SWC.
SWC has appealed against CLB's July 27 order by justice P Majumdar and S Balasubramanian, directing the induction of three nomineesof the government in addition to the existing CLB nominee SK Hazari into its board. The CLB had frozen the existing board for two years, where no changes would be possible.
Till the hearing on these cases are completed, the company will not be able to hold any board meeting because the government nominees will have to be appointed at the very first meeting.
