Bombay High Court Monday questioned the Union government over its decision to extend the visa of a Pakistani national with a criminal record who has been living in Mumbai for a year.

The Union government, through additional solicitor-general Kevic Setalvad, had in December last year stated that the manís visa had been extended by only 45 days because of pending criminal cases against him.

A petition by Dargah Hazrat Khwaja Mansurul, a shrine in Bhandup, alleged that the Pakistani national Sayyed Waseem-ur-Rehman Shah was trying to grab its land. The petitioner claimed that despite offences being registered against Shah, he was moving around freely in a red-beacon car.

The court had questioned how such a person could be allowed to go free when the vehicles of even High Court judges were routinely checked.

A division bench of Justice Abhay Oka and Justice A P Bhangale asked the Union home department to file an affidavit explaining why Shahís visa was extended for a year. The case has been adjourned till February 26.
