A local court on Saturday sentenced a 24-year-old man to seven years of rigorous imprisonment for kidnapping and sexually assaulting a minor. The court of Additional District Sessions Judge Gurvinder Kaur also slapped a penalty of Rs 20,000 on the guilty.
Rohit Kumar, a resident of Hathras, Uttar Pradesh, was found guilty of kidnapping and sexually assaulting a 13-year-old girl from Pinjore. The girl had gone missing from her house in Ram Seuri village on June 25, 2012 and was taken to Kanpur by Rohit, a tempo driver in Pinjore. About eight-months later she contacted her father and gave him her whereabouts, and informed her that she was coming to Pinjore in April with Rohit. Her father then informed the police. He had lodged a complaint with the Pinjore police three days after his daughter had gone missing. On April 4, Rohit was arrested at the Surajpur bus stand, while the girl was handed over to her parents.
However, stating that she was in love with Rohit and had gone with him to Kanpur willingly, the minor turned hostile before the court. She also denied that Rohit had raped her. Taking note of her age, the court ruled that her consent was immaterial as she was a minor. The medical examination of the girl had revealed that the possibility of rape could not be ruled out. ďEven if she has turned hostile, the medical evidence proves that rape has been committed upon her by the accused, who had taken her way from the custody of her parents,Ē the court said.
The Judge convicted Rohit for offences under Section 363 of the Indian Penal Code(IPC) and Section 4 of the Protection of Children from Sexual Offences Act(POCSO). While imposing seven years imprisonment of kidnapping, the Judge also sentenced Rohit to seven years of imprisonment for sexual assault. The two sentences will run concurrently.
