Transfer row: HC issues notice to DGP on contempt plea

The Gujarat High Court on Friday issued a notice

to Director General of Police (DGP) Chitranjan Singh on a contempt of court petition filed by a head constable.

A division bench of Justices Jayant Patel and C L Soni also asked Additional Director General of Police (Administration) A K Singh to file his reply.

Head Constable Haroon Yusufbhai Kadiwala, the

petitioner, has challenged the order of ADGP Singh, refusing to transfer him from Himatnagar to Surat despite the High Court’s

order.

Kadiwala, who joined the police force in 1989 and was posted in Surat city, was transferred to Himatnagar in Sabarkantha in March 2010, though he had not sought such a transfer, the petition says.

He challenged the transfer and division bench of the High Court upheld it on April 12 this year, directing the authorities to take proper decision within ten days, said his lawyer, Mukul Sinha.

But Additional DGP issued another order, saying that Kadiwala could not be sent back to Surat as a departmental inquiry was pending against him there.

This was a breach of High Court’s order, the petition claims.

Next hearing is on July 31.
