SC issues notice to govt on plea against Aadhaar

The Supreme Court on Friday sought a response from the Centre on a PIL, which has challenged issuance of Aadhaar numbers by the Unique Identification Authority of India on the ground that the move lacked the mandatory sanction from Parliament.

A Bench led by Chief Justice of India Altamas Kabir issued notices to the Ministry of Finance, the Planning Commission and the UIDAI, seeking replies on the contention that Parliament was “circumvented” in the implementation of the scheme.

The PIL has been filed by former High Court judge K S Puttaswamy. Senior advocate Anil Divan, appearing for the petitioner, contended that the scheme being implemented through an executive order issued under Article 73 on January 28, 2009 for giving identification numbers under the unique identification number project for all citizens and residents, including illegal immigrants, was not legal.

“When the National Identification Authority of India Bill, 2010 for the same purpose is pending before Parliament and the relevant standing committee had rejected the Bill on December 11, 2011, is it not circumventing Parliament?” he questioned.
