Prima facie forgery case against Vijay Mehta faction: Magistrate

An additional chief metropolitan magistrate has observed that prima facie, a case of forgery was made out against three members of the Vijay Mehta faction of Lilavati Kirtilal Mehta Medical Trust that runs Bandra’s Lilavati Hospital.

The magistrate was hearing a plea challenging an economic offences wing (EOW) report denying forgery.

The Charu and Kishore Mehta faction of the trust has accused Vijay, his sister Rekha Sheth, a permanent trustee, Bharat Goradia, chartered accountant and former secretary of the trust, and Louella Frank, employed in the finance department of Lilavati Hospital, of siphoning crores by forging a minutes book and appointing Vijay a permanent trustee.

The magistrate said in an order dated December 12, “Prima facie, accused 1 (Vijay) and accused 2 (Sheth) used forged documents to claim status of permanent trustee of (Vijay) before the charity commissioner.”

Since Vijay died in July 2010, the case against him has been abated. The court, however, issued summons to Sheth, Goradia and Frank to appear on December 26.

About the role allegedly played by Frank and Goradia, the magistrate said, “There are prima facie sufficient reasons to believe they agreed to do alteration in the minutes book in the nature of forgery at the instance of the accused.”

EOW had on June 6, 2011, submitted a ‘B summary’ report stating the complaint filed by Kishore alleging forgery was false.
